Terms of Service

These Terms of Service ("Terms") govern your use of the VivaSense app and website (the "Service"), provided by Viva Home Tech S.L. (CIF B93776169). By creating an account or using the Service, you agree to these Terms.

1. The Service

VivaSense is a free companion app for customers of Viva Home Tech and its brands (Viva Home Air, Viva Energética, Viva Smart). It lets you monitor your systems, book services, track jobs, chat with our team and manage your account. Services you book through the app are provided under our separate service and warranty terms.

2. Your account

• You must provide accurate information and keep your login credentials secure.
• You are responsible for activity under your account.
• You must be at least 16 years old to use the Service.

3. Acceptable use

You agree not to misuse the Service, including: attempting to disrupt or gain unauthorised access to it, uploading unlawful or harmful content, or using it in violation of applicable law. Chat is intended for communication with our team about your services.

4. Bookings & payments

Requesting a service through the app is a request that we confirm separately. Prices, scheduling, warranties and cancellations are governed by the service agreement applicable to the work performed.

5. Availability & changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may update, suspend or discontinue features at any time.

6. Intellectual property

The VivaSense name, logo, app, design and content are owned by Viva Home Tech S.L. and protected by law. You may not copy, modify or redistribute them without our written permission.

7. Limitation of liability

To the fullest extent permitted by law, the Service is provided "as is". We are not liable for indirect or consequential damages arising from your use of the app. Nothing in these Terms limits any rights you have as a consumer under Spanish law.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if these Terms are breached.

9. Governing law

These Terms are governed by the laws of Spain. Any disputes are subject to the competent courts, without prejudice to mandatory consumer-protection rights.
